The South African Patent Office was recently the first in the world to grant a patent for an invention purportedly created by an artificial intelligence, on an application naming the artificial intelligence as inventor. We examine the basis of this grant from the Patent Officer’s perspective and consider the surrounding substantive questions that remain.
