World IP Day was celebrated in Cape Town with a touch of elegance.  Mansoor Parker, Executive partner of law firm ENSAfrica shared his wisdom on impact of tax on sport licensing.  Licensees who use marks, logos or image rights may obtain the right of such use from the licensors in a few different ways. The legal classification of these rights, the nature of the transaction granting the licensee the use of these rights and the geographical location where these rights are used by the licensee determines the tax treatment thereof. Licensees may incur withholding tax obligations and tax filing and reporting obligations. It is important that licensees develop a viable legal and tax compliance strategy in order to avoid non-compliance with South Africa’s tax laws or to avoid their structures being challenged by the South African Revenue Service.
